SB 35, sponsored by Sen. Linda Newell, D-Littleton, would allow nonprofits, religious groups and public schools to enroll new workers automatically in retirement-savings plans. The employees could choose to opt out later.

Federal law allows private companies to use automatic enrollment, but the Employee Income Retirement Security Act (ERISA) is silent when it comes to not-for-profit organizations. Many states are passing laws now to permit the practice, Newell said.
