Uncompensated trauma care to persons injured in motor vehicle accidents in Colorado: Establishes program in the Department of Public Health and Environment to reimburse emergency and trauma-care providers for uncompensated care provided to patients injured in a motor-vehicle accident. Allows reimbursements for uncompensated trauma care to licensed ambulances, licensed air ambulances, trauma physicians and trauma centers. Establishes the program fund in the state treasury, consisting of moneys credited to the program fund from a $16 fee on motor vehicle registrations and moneys recovered from responsible parties for the payment of trauma care that was reimbursed by the program fund. Money saved from school district mill levy: For the 2008-09 budget year, and each budget year thereafter until a court has entered a final judgment in Mesa County Board of County Commissioners v. Colorado Department of Education, directs the state treasurer to transfer to the School District Reimbursement Account (created by the bill) an amount equal to the savings that result to the state from the mill levy stabilization plan enacted through the School Finance Act of 2007. If the court rules in favor of the plaintiffs, requires the General Assembly to appropriate the money in the account to the Department of Education to be distributed to school districts to assist the districts in paying taxpayer refunds. If the court rules in favor of the department, requires the General Assembly to transfer the moneys in the account to the state education fund for use by the state.

Authorizes the Colorado Tolling Enterprise to designate part or all of Interstate 70 between Floyd Hill and the Eisenhower Johnson Memorial tunnel as a toll road. The tolls are limited to a maximum of $5.00 per vehicle and two-thirds of the revenue generated is to be used to expand the highway to alleviate congestion and the rest used for administration, operation and repairs. Residents of Gilpin, Clear Creek and Summit counties and businesses with vehicles registered in those counties would be exempted from the tolls. The CTE is encouraged to seek waivers from the federal government to prevent the loss of federal funding.

Transportation Infrastructure Preservation Act: Imposes an additional $6 per day fee on daily vehicle rental fees; a transportation infrastructure preservation fee equal to the difference between the amount of the current ownership tax imposed on a vehicle and $75; and, a bridge safety trust fund fee equal to $25 on up to two vehicles registered to the same owner. Vehicles on which the ownership taxes total less than $75 during 2008 are exempted from the transportation preservation fee. Some farm and other vehicles are exempted from the bridge safety trust fund fee. These fees would be suspended in any year beginning with fiscal year 2010-11 if the legislature reduces the amount of General Fund transfers to transportation under current law. It also directs how much and to what purposes revenues in both funds can be used. Directs the Department of Transportation to prominently display on its web site an interact map showing the location of every structurally deficient bridge in the state.

Fair and accountable insurance rates as amended by the House Business Affairs and Labor Committee (FAIR bill): creates the
Fair Accountable Insurance Rates Act for health insurance rates that take effect on or after January 1, 2009. Insurance companies are required to report the number of lives insured in the prior year, and file complete and detailed descriptions of their rating and renewal underwriting practices
with the Commissioner of Insurance. Rate filings that include rate increases, must be filed with the commissioner at least 60 days prior to the proposed use of the rates. If the commissioner does not
approve or disapprove the rates filed within a 60-day period, the insurance company may use the rates on the condition that the commissioner may disapprove the rates later.

Teacher Quality Recruitment Retention: Requires that the Colorado Department of Education design and administer a biennial teaching and learning conditions survey to all teachers in state public schools. The survey will assess how teaching and learning conditions predict student achievement, and correlate to teacher retention and school administration. Results from the survey may be used as a resource for school improvement. Beginning May 1, 2009, the CDE shall award a stipend of $3,000 to employed public school teachers holding a certification from the National Board for Professional Teaching Standards. A measure to be referred to the voters to change the signature requirements for placing constitutional and statutory initiatives on the ballot and using the total vote cast for governor at the previous general election as the base for determining the number of required signatures. The number of signatures needed to place a constitutional initiative on the ballot would be set at 6 percent and the number needed to place a statutory initiative on the ballot would be set at 4 percent of the total votes cast for governor. In addition, at least 70 percent of the signatures gathered to place a constitutional initiative on the ballot must be gathered in equal amounts from each of the state’s congressional districts. Initiative petitions for constitutional amendments must be filed with the secretary of state at least seven months before the election while petitions for statutory initiatives must be filed at least three months as required under current law. A two-thirds vote of all the members in each chamber would be required for the legislature to amend or repeal any law enacted by initiative for a period of six years after it becomes effective. The Senate State, Veterans and Military Affairs committee approved amendments reducing the percentage of signatures needed from congressional districts to 35 percent and changing the time for submitting petitions for constitutional amendments to five months before the election.
